Bylaws

I.Council Membership

The Cache Valley Regional Council shall consist of:

  • Three mayors from participating cities north of Logan to be designated by the
    mayors of the participating cities in that area.
  • Three mayors from participating cities south of Logan to be designated by the
    mayors of the participating cities in that area.
  • The mayor of Logan City and a member of the Logan City Council to be
    designated by the Council.
  • The Cache County Executive and a member of the Cache County Council to be
    designated by the Council.
  • A member of the Franklin County Commission to be designated by the
    Commission.
  • A mayor from Franklin County to be designated by the Franklin County Commission.
  • A member of the Utah Legislature who represents Cache County to be
    designated by the Cache County Council.
  • A member of the Idaho Legislature who represents Franklin County to be
    designated by the Franklin County Commission.
  • The President of Utah State University.
  • Ex Officio (non-voting) members as deemed necessary by the Council
II. Terms and Appointments

A. The Cache County Executive, Mayor of Logan City, and President of Utah
State University shall serve as long as they hold their respective positions.

B. Except as specified in “II.C” below, all other members of the Council shall serve for a term of two years, but may be re-appointed by the appointing body.

C. Of the remaining twelve seats (excluding those specified in II.A above), the initial terms of six shall end December 31, 2007 and the initial terms of the
other six shall end December 31, 2008. The terms for each of these twelve seats shall be determined by lot.

D. Vacancies will be filled by the appointing body.
1. Council positions held by members who have three consecutive non- excused absences will be considered vacant.
2. If a council member no longer holds the office that they represent
on the Council, the position will be considered vacant.

III. Powers and Duties
  1. The Council shall consider important issues affecting Cache Valley and:
    1. Promote cooperation between local, state, and federal officials regarding
      those issues.
    2. Educate elected officials and the general public regarding those issues.
    3. Function as a lobbying body on issues important to Cache Valley.
  2. The Council may create committees or utilize existing committees as it deems
    appropriate.
  3. Members of the Council representing entities who participate in the funding of the Cache Planning and Development Office shall constitute the governing body of that office.
IV. Meetings
  • The Council shall meet the third Monday of each month at 4:30 P.M. If that
    date is a legal holiday, another meeting day may be designated.
  • Meetings shall be held in Logan, Utah, except that at least two meetings per year will be held in Preston, Idaho.
  • All meetings shall be duly advertised and open to the public.
  • Conduct of meetings not specifically provided by these bylaws shall be
    governed by Robert’s Rules of Order.
V. Chair and Vice Chair
  • The chair and vice chair shall be elected by a majority of the full membership of the Council from among the members of the Council.
  • The terms of the chair and vice chair shall be one year, starting with the first meeting in January, except that the terms of the first chair and vice chair shall end December 31, 2006.
  • The chair shall preside at all Council meetings and shall have the full right to debate and vote. During her/his absence, the vice chair shall preside.
VI. Agendas and Minutes
  • The chair (or in her/his absence, the vice chair) shall set the agenda for the
    Council. However, items shall be placed on the agenda at the request of
    any Council member.
  • The Council shall:
    • Provide copies of its agenda to local newspapers and other local news media at least forty-eight hours prior Council meetings.
    • Post its agenda on the websites of both Cache and Franklin Counties
      at least forty-eight hours prior to Council meetings
    • Provide copies of its agenda to Council members and all Cache and
      Franklin County mayors at least ninety-six hours prior to Council
      meetings.
  • Minutes shall be kept of all Council meetings and shall be:
    • Provided to Council members at the same time as their agendas.
    • Posted on the websites of both Cache and Franklin Counties.
VII. Substitutes, Quorum, and Voting
  1. Council members shall make every effort to attend each meeting.
    However, if necessary, a Council member may designate an elected
    official from the jurisdiction she/he represents as a substitute. In the case
    of the Utah State University President, a vice president may be designated.
    Substitutes shall have full right to debate and vote.
  2. A quorum shall consist of a majority of all Council members and shall be required for transaction of all business by the Council.
  3. All actions shall require the affirmative vote of a majority of all Council
    members and each member shall have one vote, except as noted by VII.D
    below.
  4. Regarding matters pertaining to governance of the Cache Planning and
    Development Office, provisions VII.B and VII.C shall refer only to those Council members representing entities who participate in funding that office.
VIII. Changes to the Bylaws

Changes in the bylaws shall require a two-thirds vote of the total Council membership.
